Valor Sim Racing Privacy Policy

This Privacy Policy explains how Valor Sim Racing LLC (“Valor,” “we,” “us,” or “our”) collects, uses, discloses, and retains information through the Valor website, accounts, desktop applications, Valor Pro, Team Hub, Valor Competition, overlays, Film Room, push-to-talk and voice features, artificial-intelligence features, Baseline services, updates, and support (collectively, the “Services”).
This Policy should be read with the [Master Service Terms](https://www.valorsimracing.com/masterterms) and the [Baseline and Driver Data Rights Policy](https://www.valorsimracing.com/baseline-rights).
## 1. At-a-glance summary
- Valor collects account, entitlement, device, simulator telemetry, Baseline, voice/transcript, team, venue, and support data needed to operate and improve the Services.
- Valor’s two Baseline settings control whether Team Hub members may drive or export your Baseline. They do not control Valor’s ownership or separate rights.
- When you affirmatively accept the Baseline and Driver Data Rights Policy, you assign ownership of covered Baselines to Valor and receive a broad, permanent Driver License back.
- You authorize Valor to publish your real name and driver or display name in direct connection with attribution, posting, promotion, licensing, sale, or distribution of a covered Baseline. This does not, by itself, authorize use of your photograph, face, voice, or likeness or a false endorsement claim.
- Valor does not intentionally sell payment-card data or ordinary account contact information. Commercialization of Baselines and authorized driver-name attribution is addressed separately below.
- You may request access, correction, or deletion of personal information by emailing [valorrace@gmail.com](mailto:valorrace@gmail.com), subject to verification, legal exceptions, security records, Valor’s ownership, the Driver License, name-use permission, and materials already published or distributed.
## 2. Scope and responsible company
This Policy applies to information Valor controls through the Services. It does not govern an independent venue, team owner, league, simulator provider, payment provider, or other third party acting for its own purposes.
Valor Sim Racing LLC is responsible for the practices described here. Team Hub administrators and Valor Competition operators may separately control information they collect from their members, employees, customers, entrants, or guests.
## 3. Information we collect
### 3.1 Account, identity, and contact information
We may collect your name, driver display name, email address, Wix member or contact identifier, organization or team name, account status, support communications, policy acceptances, and related account details.
### 3.2 Purchase, entitlement, and access information
We may collect plan name, order and subscription identifiers, billing status, renewal and cancellation status, seat or rig count, activation dates, entitlement flags, access-key records, team or venue role, device-lock status, and other fulfillment information. Payment processors handle payment-card data under their own policies. Valor may receive limited transaction information such as payment status, amount, date, and card type or last digits.
### 3.3 Device, application, and network information
We may collect application version, update status, operating-system and device labels, hashed device fingerprints, approximate network information such as IP address, timestamps, error and diagnostic logs, security events, rate-limit data, and service-request metadata.
Valor’s current desktop design stores the raw local device identifier on the device and sends a one-way hashed fingerprint, device label, operating-system information, and application version for authorization and support. Technical implementation may change as security and compatibility needs evolve.
### 3.4 Simulator, session, telemetry, and performance information
We may collect or derive simulator, car, track, session, lap, sector, speed, throttle, brake, steering, gear, fuel, tire, incident, validity, quality, sample, setup-adjacent, comparison, event, report, and similar performance information. We may create summaries, analytics, rankings, trends, coaching signals, and other derived information.
### 3.5 Baselines and Baseline metadata
We may collect the Baseline trace or package and associated driver, track, car, simulator, session, lap-time, incident, quality, sample-count, geometry, version, provenance, sharing-permission, consent-version, review, and archival metadata.
The personal Baseline archive is designed to retain each eligible Baseline locally and, when sync succeeds, in Valor’s cloud archive. A Team Hub working set may be smaller and may change over time. Removing an item from Team Hub does not necessarily remove the permanent archive.
Baseline assignment, Valor ownership, the Driver License, teammate controls, attribution permission, and legacy Baselines are explained in the Baseline and Driver Data Rights Policy.
### 3.6 Voice, push-to-talk, transcript, and AI information
When you intentionally activate push-to-talk or another voice function, Valor may capture the audio needed to recognize the request. Current speech recognition may send the voice clip to a third-party speech-recognition provider. Valor may receive and process the resulting transcript together with relevant telemetry, session state, settings, and recent context, and may send that text context to an AI provider to generate a response.
Current text-to-speech output may be generated locally on the device. Valor may use other speech providers in later releases and will update this Policy or provide an in-product notice if the handling materially changes.
Valor is not designed to record background room audio continuously or create a voiceprint for identity recognition. Do not speak sensitive information into Valor.
### 3.7 Team Hub information
We may collect team name, join code, membership, roles, seat assignments, driver names, online status, active track sessions, shared PB and recent Baselines, team permission selections, reports, comparisons, and team activity. Authorized team owners or members may see information according to their role and the applicable Baseline settings.
### 3.8 Valor Competition and venue information
We may collect organization and venue identity, owner/manager role, licensed seats or rigs, rig assignments, driver display names, session and event details, results, reports, rankings, challenge progress, Baselines, display pairings, and public-display state. A Valor Competition operator may choose to show driver display names and performance information on venue screens.
The Competition application may create local organization data, reports, caches, backups, event state, settings, and same-network display-pairing information on the operator’s computer.
### 3.9 Website, cookie, and communications information
We and our website providers may collect cookie identifiers, browser and device details, page and referral information, general location inferred from IP address, site interactions, consent choices, and email delivery or engagement data. Cookie choices may be available through the website banner or browser settings.
### 3.10 Information from others
We may receive information from a team owner, venue operator, purchasing organization, teammate, event operator, support contact, simulator or platform integration, Wix, payment provider, or another user who has authority to provide it.
## 4. How we use information
We may use information to:
- create, authenticate, fulfill, and manage accounts, plans, keys, seats, rigs, teams, venues, and subscriptions;
- operate overlays, voice features, AI responses, telemetry analysis, Film Room, reports, comparisons, updates, displays, Baseline libraries, and other product features;
- own, archive, index, qualify, review, select, measure, compare, improve, attribute, publish, distribute, license, sell, transfer, and commercialize Baselines under the Baseline and Driver Data Rights Policy;
- personalize and improve coaching, product performance, models, prompts, data packs, official Baselines, and user experience;
- migrate eligible historic Team Hub Baselines into driver archives and prevent duplicate records;
- provide support, troubleshoot, communicate, and respond to requests;
- process payments, refunds, cancellations, and entitlement changes;
- protect access keys, devices, accounts, users, systems, and intellectual property;
- detect fraud, abuse, tampering, security incidents, and violations;
- produce aggregated or de-identified analytics, research, benchmarks, and business insights;
- comply with law, enforce agreements, and establish, exercise, or defend legal claims; and
- perform a merger, financing, reorganization, asset sale, acquisition, or similar business transaction.
## 5. Baseline ownership, attribution, and personal information
A Baseline may begin as information associated with a driver. When the person with authority affirmatively accepts the Baseline and Driver Data Rights Policy, that person assigns to Valor all assignable right, title, and interest in the covered Baseline. Valor gives the Originating Driver a broad Driver License back. Valor may use, modify, publish, distribute, export, license, sell, sublicense, assign, transfer, or give away the Accepted Baseline.
The same acceptance authorizes Valor to use the Originating Driver’s real name and driver, account, or display name in direct connection with the Baseline. Valor may identify the driver in a Baseline title, public post, official listing, website or social-media promotion, data pack, marketplace listing, announcement, venue display, historical archive, sale, license, transfer, or distribution.
Valor may place the authorized name beside factual performance information such as lap time, simulator, track, car, session, date, rank, quality, record, or official status. Valor may also choose to use a pseudonym, technical label, or de-identified package.
The Baseline acceptance does not, by itself, authorize Valor to use a driver’s portrait, photograph, face, avatar artwork, voice, signature image, or other likeness, disclose private contact or payment information, or falsely claim that the driver endorses an unrelated product. Accurate attribution or promotion of a driver’s Baseline is not, by itself, an endorsement claim.
Valor may retain internal provenance, ownership, acceptance, attribution, audit, and contact records to operate the archive, verify chain of title, prevent misuse, and comply with law. Valor may maintain records showing who created, submitted, or assigned a Baseline even when a distributed copy is de-identified.
Valor does not characterize a transfer of a de-identified Baseline as a sale of ordinary account contact information. A named Baseline distribution may include personal information because it identifies the driver. If applicable law treats a particular Baseline or name transaction as a sale, sharing, or other regulated disclosure of personal data, Valor will provide and honor any non-waivable notice or choice required for the personal-data component while preserving assigned ownership and other rights to the extent permitted by law.
## 6. When we disclose information
We may disclose information:
- to Wix and other website, account, hosting, database, content-delivery, email, and infrastructure providers;
- to payment processors and subscription providers;
- to speech-recognition, AI, text-processing, error-monitoring, security, analytics, and support providers;
- to Team Hub owners, teammates, and organization administrators according to role, feature, and permission settings;
- to Valor Competition owners, managers, venue staff, participants, customers, and display audiences as directed by the operator and reasonably necessary for the feature;
- to a recipient, buyer, licensee, distributor, or transferee of a Baseline or Baseline-derived product, including the authorized driver name where the Baseline and Driver Data Rights Policy permits;
- to professional advisers, auditors, insurers, financing sources, and transaction counterparties under appropriate duties;
- to authorities or others when reasonably necessary to comply with law, protect safety or rights, investigate fraud or security, or enforce agreements; and
- in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of the business or assets.
Service providers may process information only for the services they provide or as otherwise permitted by their contracts and applicable law. Third-party services may maintain their own data under their privacy policies.
## 7. Team and public-display choices
Valor currently provides two driver-controlled Team Hub Baseline settings:
1. **Allow Team Members to Drive My Baseline.** When enabled, authorized teammates may load and use the Baseline within Valor as a driving or comparison reference. This does not itself authorize a file export.
2. **Allow Team Members to Export My Baseline.** When enabled, authorized teammates may download or export the Baseline file. Once another person lawfully receives a copy, turning the setting off cannot recall that copy.
These settings govern ordinary teammate access only. They do not restrict Valor’s ownership or rights to archive, analyze, select, attribute, publish, export, license, sell, transfer, give away, or otherwise use an Accepted Baseline. They also do not require deletion of archived permission snapshots, ownership or acceptance records, audit records, backups, or copies already exported.
A venue or team administrator controls organization features and public displays. If you do not want your display name or performance shown at a venue, raise that request with the operator. Valor will assist with verified requests where reasonably possible, but the operator remains responsible for its independent display choices.
## 8. Retention
We retain information for as long as reasonably necessary for the purposes described here, including to provide active Services, maintain archives, honor licenses, secure systems, prevent fraud, comply with tax and accounting rules, resolve disputes, and enforce agreements.
Retention varies by data type:
- entitlement, transaction, acceptance, security, and audit records may be kept for the applicable legal, accounting, fraud-prevention, and dispute period;
- active team, venue, session, and support data may be kept while the account or organization is active and for a reasonable period afterward;
- local settings, logs, Baselines, caches, reports, audio-response caches, device identifiers, and backups may remain on a device until removed by the device owner or cleaned by the application;
- Accepted Baseline content and related ownership, attribution, provenance, and acceptance records may be retained indefinitely under Valor’s ownership and governing rights;
- legacy Baseline content may be retained for the period and purposes allowed by the terms accepted when it was submitted, another valid license, or law;
- de-identified or aggregated information may be retained indefinitely; and
- backups may retain information until overwritten under normal backup cycles.
Deleting an application does not necessarily cancel a subscription, delete a Wix account, remove local files stored elsewhere, or erase cloud records.
## 9. Security
Valor uses administrative, technical, and organizational safeguards designed for the nature of the information and the size of the service. No system, transmission, local network, or storage method is completely secure.
You are responsible for protecting your access keys, email account, devices, router, local network, and venue displays. Valor Competition’s same-network display feature should be used only on a trusted and appropriately secured network with firewall and pairing controls.
If Valor discovers a security breach affecting protected information, Valor will investigate and provide notices required by applicable law.
## 10. Your privacy requests
Subject to verification and applicable exceptions, you may ask Valor to:
- confirm whether Valor maintains personal information about you;
- provide a reasonable copy of personal information associated with your account;
- correct inaccurate account information;
- delete personal information that Valor is not required or permitted to retain;
- close an account or deactivate an access key; or
- explain or update certain sharing choices.

Valor may request additional verification and may deny or limit a request where identity cannot be verified, the request would affect another person, retention is required or permitted by law, the information is needed for security or legal claims, or the request is excessive or abusive.
Deletion of personal identifiers does not reverse an assignment, terminate Valor’s ownership, end the Driver License, or automatically withdraw the Baseline-related name permission. Valor may retain or de-identify Baselines, provenance, ownership and acceptance records, authorized attribution, security logs, transaction records, and backups as described here and in the Baseline and Driver Data Rights Policy.
Valor may consider a verified request to change future attribution, but does not promise to remove accurate attribution or recall materials already lawfully posted, licensed, sold, transferred, cached, archived, or distributed. Valor will honor non-waivable rights required by applicable law.
Authorized agents may submit a request where required by law, subject to proof of authority and identity. You may appeal a denied request by replying to Valor’s decision with “Privacy Appeal” in the subject line.
## 11. No targeted advertising program or sale of ordinary account data
Valor does not currently operate a program to sell ordinary account contact information for money or use it for cross-context behavioral advertising. If Valor adopts materially different advertising or personal-data sale practices, Valor will update this Policy and provide any notice or opt-out required by applicable law.
This section does not limit Valor’s ownership of Accepted Baselines, the Driver License, the authorized Baseline-related name use, or Valor’s ability to commercialize de-identified, aggregated, performance, telemetry-derived, or Baseline content as described above.
## 12. Children and teens
The Services are not directed to children under 13, and Valor does not knowingly collect personal information online from a child under 13. If you believe a child under 13 has provided information, contact [valorrace@gmail.com](mailto:valorrace@gmail.com).
Users age 13 through 17 must have a parent or legal guardian accept the governing terms and supervise use. A parent or guardian must also make any Baseline assignment and name authorization on the minor’s behalf to the fullest extent permitted by law. Team and venue operators are responsible for legally sufficient notice and parental permission for minors who use their rigs, participate in events, submit information or Baselines, or appear in named public displays.
## 13. International and out-of-state users
Valor is based in the United States. Information may be processed in the United States and other locations where providers operate. Those locations may have different privacy laws. If you use Valor outside New Mexico or the United States, you are responsible for local requirements that apply to your use, and Valor will provide mandatory rights that cannot lawfully be waived.
## 14. Changes to this Policy
Valor may update this Policy to reflect product, provider, legal, security, or business changes. Valor will post the updated version and effective date and provide additional notice when required. A change will not reverse ownership or revoke rights already assigned or granted. A new assignment or materially expanded name permission for an earlier Baseline requires an acceptance that covers that Baseline unless another valid agreement already provides it.
